ArcBest II, Inc. dba U-Pack (“our,” “we,” or “us”) is committed to respecting your privacy. We use the information we collect via upack.com and our other web properties, domains, and websites to provide you a positive customer experience, inform you of relevant logistics solutions and provide the most robust online tools and applications in the transportation industry. This Privacy Policy applies to U-Pack websites that link to or reference this Policy and describes how we handle your information collected through such sites. By visiting our website or using any of our services, you consent to U-Pack’s collection, use, disclosure, transfer and storage of information relating to you as set forth in this Privacy Policy. U-Pack may review and update this Privacy Policy without prior notice. If we change this Privacy Policy, the updated policy will be posted to this page and the date first written above shall indicate its effective date.

What information does U-Pack collect?
We may collect data, including personally identifiable information, about you as you use our websites, services, and interact with us. Examples of personal information we may collect includes names, business title, addresses, e-mail addresses, preferences, information necessary to fulfill requests, and telephone numbers. We may also collect information that is related to you but that does not personally identify you.
We collect such data for many reasons, including but not limited to: processing a transaction, providing you with information about your interaction, enabling the use of certain web tools, providing you information about other services available, customer service purposes, or responding to your inquiries. We may also collect and use your data in order to comply with legal and regulatory requirements and for benchmarking and analysis. We may also collect IP addresses, usage statistics, browser information and other information generated by your use of our websites through the use of cookies, web logs, beacons, and other similar tools. This information allows us to understand and improve the customer experience on our websites and for administration, personalization, security, analysis, advertising, and marketing purposes.
In order to provide services to you and improve U-Pack’s websites, we may engage third-party service providers and/or vendors. In the process of supplying services to U-Pack, these third parties may need to collect information about you or we may need to provide your information to them.
U-Pack may also collect information about you from other sources to help us correct or supplement our records and improve the quality or personalization of our services to you. While not always collected through our websites we collect and store information about every shipment and transaction handled by us so that we can efficiently provide the services you require. We use information about our customers, their shipments, and their shipping activity to provide or enhance our services, to communicate with our customers about additional services they may find of value, to establish credit, to bill for services, to comply with government regulations, and to build a more complete picture of our customer and our interactions.
How is my information saved and protected?
We employ physical, administrative and technical safeguards and security techniques to appropriately protect confidential information from unauthorized access, use, and disclosure.
Although we work hard to protect personal information that we collect and store, the Internet is not 100% secure and we cannot guarantee or warrant that our safeguards will prevent every unauthorized attempt to access, use or disclose your information, therefore we are not responsible for any damages or liabilities relating to any such incidents to the fullest extent permitted by law.
Because of the nature of transportation and logistics services and the varied parties involved in providing services to you, we cannot maintain complete confidentiality of information that is printed and placed in plain view on a shipment or package or that is required to be disclosed in order to arrange, perform, or manage services for you.
How do I change my personal or company information?
Registered users may: (1) contact their U-Pack representative, or (2) e-mail passwords@arcb.com to request a change to registration information. You are entirely responsible for any and all activities that occur under your account.
Personal information provided at the time of registration may be deleted if the user does not access the website within 6 months as a logged-on user.
Will U-Pack disclose the information it collects to third parties?
U-Pack may disclose information to third-party vendors, service providers that work with U-Pack, or to its affiliated companies. We will only share information to non-affiliated third parties to help us provide or advertise a product or service to you or that are complementary to our services. Examples of third parties we work with are call center operators, shippers, servicers, transportation service providers, brokers, 3PLs, information processors, advertising or marketing partners, or financial institutions. Third parties which help us provide or advertise the services to you only have access to the information necessary for them to complete their service.
U-Pack may be required to disclose personal information to the authorities, law enforcement agencies, government agencies, or other legal entities. We may disclose information as required by law, litigation, or as a matter of national security to:
a. comply with valid legal process including subpoenas, court orders or search warrants, and as otherwise authorized by law;
b. in the event of an emergency that threatens an individual's life, health, or security; or
c. to the extent permitted by applicable law in special cases in which we believe it is reasonably necessary to investigate, identify, or take preventive measures or bring legal action against someone who may commit or cause harm, fraud, abuse, or illegal conduct, such as a threat of harm to you or anyone else, interference with our rights or property.
Using our website or services may link to third party websites, services, and applications. U-Pack is not responsible for any personal information collected through these means. Information collected is governed through the third party's website's privacy policy and other policies. Any interactions you have with third-party websites, services, or applications are beyond the control of U-Pack. When you post information to or through such services, those websites' privacy policies and cookie usage policies apply directly. We urge you to read the privacy and security policies of any external websites.
Will U-Pack use this information to send me promotional materials?
Registered users and existing customers at times may receive newsletters and other promotional materials via e-mail. We always provide clear instructions are always provided to opt-out of future e-mails. Furthermore, print materials are sent to existing customers on a regular basis. You may also opt-out of these print mailings by contacting your U-Pack representative.
Miscellaneous
Comments, suggestions, or materials sent or transmitted to us, or uploaded or posted by you to U-Pack websites shall be deemed to be non-confidential. We shall have no obligation of any kind with respect to such comments, suggestions, or materials, and we shall be free to use and distribute them to others without limitation, including, but not limited to, developing and marketing products. U-Pack websites may feature bulletin boards, blogs, or forums. Any information that you choose to submit via such a forum may be read, collected, or used by others who visit these forums.
Our website is not intended for children under 13 years of age. No one under age 13 may provide any information to or on our website. We do not knowingly collect personal information from children under 13. If you are under 13, do not use this. CALIFORNIA RESIDENTS
The California Consumer Privacy Act of 2018 (“CCPA”) as amended and expanded by the California Privacy Rights Act of 2020 (“CPRA”) provides California residents (referred to in this section as “consumers”) with certain rights concerning their personal information. This section applies only to California residents who interact with U-Pack for non-employment purposes. The following categories of personal information are the categories we collect for consumers who interact with us for non-employment-related purposes, including any consumers who have interacted with us during the previous twelve (12) months).

B. How Long We Retain Personal Information
Personal Information is retained for only as long as necessary to perform the purposes set forth in this Privacy Policy or to comply with legal requirements and U-Pack internal policy.
C. How We Collect Personal Information
Directly from consumers – for example, through interactions with U-Pack via telephone or email and through a consumer’s interactions with our websites and web or mobile applications.
D. Business Purpose for Collecting Personal Information
U-Pack collects personal information for the following business purposes:
- To perform services requested by consumers and to verify their information
- To communicate with consumers about services including, but not limited to, providing accurate rates and service-related information and processing payment for services.

U-Pack does not collect or process Sensitive Personal Information (as that term is defined in the CPRA) for the purpose of inferring characteristics about consumers.
E. Categories of Information Disclosed to Third Parties for a Business Purpose
The categories of third parties to whom personal information is disclosed for a business purpose includes our affiliated entities, government agencies, and, upon a consumer’s direction or request, third-party service providers. This personal information is disclosed as necessary to comply with applicable laws, rules, regulations, subpoenas, or court or administrative orders. It is also disclosed as necessary to provide the services and functions reasonably expected by a consumer who interacts with us for non-employment-related purposes.

II. California Consumers Rights and Choices
A. Right to Know and Correct
Consumers have the right to know the categories and specific pieces of personal information U-Pack has collected, sold, shared, or disclosed, and the business purpose for doing so.
Consumers also have the right to request that U-Pack correct inaccurate personal information it maintains. However, U-Pack may deny a correction request if it determines that the personal information in its possession is more likely than not accurate based upon a totality of the circumstances. U-Pack may require the consumer to provide documentation to support their correction request.

B. Right to Opt-Out of Sale or Sharing of Personal Information
Consumers have the right to direct U-Pack not to sell or share any of their personal information.

C. Deletion Rights
Consumers have the right to request that U-Pack delete their personal information that it has collected and retained subject to certain exceptions. Such exceptions include, but are not limited to, scenarios in which the personal information is required to complete the transaction for which the personal information was collected, complying with legal obligations, or for internal uses that are reasonably aligned with the consumer’s expectations based upon their relationship with us.
D. Right to Limit Use and Disclosure of Sensitive Personal Information
When a business collects sensitive personal information for the purpose of inferring characteristics about a consumer, the consumer has the right to direct the business to limit its use and disclosure of such sensitive personal information to only the uses necessary to perform the services or to provide the goods reasonably expected by an average consumer requesting the goods or services.
U-Pack does not collect any sensitive personal information for the purpose of inferring characteristics about consumers. As such, the right to limit use and disclosure of sensitive personal information does not apply to inf the previously mentioned rights to know, correct, opt-out, and delete are still applicable.
III. Exercising Your Rights
Consumers can exercise their Rights to Know, Correct, Opt-out, and Delete, by submitting a verifiable request to U-Pack by emailing privacy@arcb.com or mailing their request to ArcBest II, Inc., Attn: Customer Experience, P.O. Only the consumer, or someone legally authorized to act on the consumer’s behalf, may make a verifiable request related to their personal information. Consumers may only make a verifiable request for access or data portability twice within a 12-month period. Before providing any requested information, U-Pack will require consumers to provide certain information in order to verify their identity or authority to make the request.
U-Pack endeavors to respond to requests within forty-five (45) days of receipt. If more time is required (up to 90 days), U-Pack will provide the reason and extension period in writing. If U-Pack denies your request for any reason, it will provide an explanation in its response to you.
U-Pack does not charge a fee to process or respond to verifiable requests unless it is excessive, repetitive, or manifestly unfounded. If U-Pack determines that the request warrants a fee, it will explain that decision and will provide a cost estimate before completing the request.
IV. Non-Discrimination/Non-Retaliation
When consumers interact with U-Pack or its websites for purposes other than employment, U-Pack will not discriminate or retaliate against consumers for exercising any of their rights under the CCPA/CPRA. Unless permitted by the CCPA/CPRA, U-Pack will not:
- Deny goods or services.
- Charge different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.
- Provide a different level or quality of goods or services.
- Suggest that a consumer may receive a different price or rate for goods or services or a different level or quality of goods or services.
COLORADO RESIDENTS
You have rights regarding our access and use of your data according to the Colorado Privacy Act. Colorado residents have rights to request the following:
- To opt out of the sale, targeted advertising, or sale of their personal information;
- To access your personal data and obtain that information in a readily accessible format;
- To correct inaccuracies in your personal data; and
- To delete your personal data.
The rights to Colorado residents under this section do not apply to an individual acting in an employment context or to a job applicant. You may authorize someone to initiate a request on your behalf. However, we will need to use reasonable efforts to identify you and the person that you authorize to act on your behalf.
We will endeavor to respond to your request within forty-five days of its submission. If we need longer time to respond, we will inform you and the reason why we need additional time.
UTAH RESIDENTS
You have rights regarding our access and use of your data according to the Utah Consumer Privacy Act. Utah residents have rights to request the following:
- Access and confirm whether we are processing your personal data;
- To request that we delete your personal data;
- To obtain a copy of your personal data in a readily usable and accessible format;
- To opt of the sale or processing of your personal data for targeted advertising

A parent or legal guardian may submit a request on behalf of their child or ward. We shall endeavor to respond to your request withing forty-five days of its submission. We may request an additional forty-five day extension when necessary. We will let you know the basis of any extension. If we do not act upon your request, we will inform you of the reason for our refusal. We may charge a fee if you submit a subsequent request within a twelve-month period.
VIRGINIA RESIDENTS
Pursuant to the Virginia Data Privacy Act of 2021, Virginia residents have certain rights with respect to their personal information. Specifically, Virginia residents have the right to request the following:
- Access to their personal information;
- To Correct their personal information;
- To Delete their personal information; and
- To Opt-Out of the sale of their personal information.
These rights apply only to personal information collected or processed in an individual or household context. They do not apply to personal information of Virginia residents that collected or processed in a commercial or employment context.
